THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN TRANSFER CIVIL MISCELLANEOUS PETITION No.637 OF 2018 ORDER:

This Transfer Petition is filed by the petitioner/husband for transfer of O.P.No.153 of 2017 from the Court of the Principal Senior Civil Judge, Kovvur, to the Court of the XVI Additional District Judge-cum-Additional Family Court, at Malkajgiri, Ranga Reddy District. The said O.P., was filed by the respondent/wife seeking divorce.

The petitioner has presented the evidence of personal service of notice. Postal article sent to the respondent is also shown to have been taken by the respondent. Therefore, it is declared that notice on the respondent has been duly served and service is complete. 3.

Learned counsel for the petitioner/husband submits that the respondent/wife is presently working in and around Hyderabad only. Further, F.C.O.P.No.2258 of 2017 filed by the petitioner is pending before the XVI Additional District Judge-cum-Additional Family Court at Malkajgiri and as such, O.P.No.153 of 2017 may be transferred to the Court of the XVI Additional District Judge-cum-Additional Family Court, at Malkajgiri, Ranga Reddy District, from the Court of the Principal Senior Civil Judge, Kovvur and to be tried along with F.C.O.P.No.2258 of 2017, which is pending on the same Court. 4.

Having regard to the facts and circumstances of the case and also having regard to the fact that the respondent herein stated Hyderabad address in the application for Passport, I am satisfied that O.P.No.153 of 2017 on the file of the Principal Senior Civil Judge, Kovvur, to be transferred to the Court of the XVI Additional District

Judge-cum-Additional Family Court, at Malkajgiri, Ranga Reddy District.

In the result, the Transfer Civil Miscellaneous Petition is allowed transferring O.P.No.153 of 2017 on the file of the Principal Senior Civil Judge, Kovvur, to be transferred to the Court of the XVI Additional District Judge-cum-Additional Family Court, at Malkajgiri, Ranga Reddy District.
