THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12817 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/accused seeking bail in crime No.134 of 2015 on the file of the P.S., Echoda, Adilabad District, registered for the offences under Section 376 IPC and Section 5(J)(II) (K)(L) of the Protection of Children from Sexual Offences Act. Heard and perused.

The allegation against the petitioner is that the petitioner had sexual intercourse with the victim girl, who is aged about 16 years and also physically challenged, and on examination by the Doctor, it was found that the victim girl was pregnant. The petitioner herein is aged about 51 years and also married.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is falsely implicated in the case. He prays this Court to grant bail to the petitioner. Considering the seriousness of the offence alleged against the petitioner, this Court is not inclined to grant bail to the petitioner herein.
