HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.10224 OF 2014 ORDER:

This petition is filed under Section 482 of Cr.P.C. to quash the proceedings in C.C.No.423 of 2010 pending on the file of I Additional Chief Metropolitan Magistrate Vijayawada on various grounds.

During hearing, learned counsel for the petitioner and the respondents brought to the notice of this court that the above C.C. is posted for arguments though the matter is pending before this court and they agreed to get the matter disposed of not withstanding the requirement to produce document summoned exercising powers under Section 91 of Cr.P.C.

Therefore, in view of the contentions of both counsel, learned I Additional Chief Metropolitan Magistrate, Vijayawada is directed to decide the Calendar Case without insisting for production of the original document of sale deed bearing No.3925 dated 3-8-2007. With the above direction, this Criminal Petition is disposed of.
