HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36350 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus directing the respondents not to demolish the Vinayaka Temple construction as per the resolution passed by the petitioner - Association on 19.08.2018, at Plot Nos.7 and 8, Aditya Nagar Phase-I, Gurramguda, Badangpet Nagar Panchayat, R.R.District, Telangana.

2) The averments in the affidavit filed in support of the writ petition would show that Aditya Nagar Colony Welfare Association claims to have purchased land in Survey Nos.180, 184 and 185 from one Sri G.Janga Reddy, represented by GPA holder Sri Pasurnuri Narasimha Reddy. The averments in the affidavit would show that on 19.08.2018, the Association resolved to construct Vinayaka Temple unanimously and now the temple is under construction. It is averred that the authorities are trying to interfere with the construction of the temple without following due process of law. On 22.10.2018, when the matter is taken up for hearing, this Court directed the petitioner to produce a copy of the permission obtained for construction of the temple.

3) Today, learned counsel for the petitioner placed on record, the letter issued by the petitioner, which discloses that said association has applied permission for further construction of the temple. 4) Having regard to the above, the petitioner shall not proceed with the construction of the temple till permission is granted by the concerned authorities. If the authorities intend to take any action, they are at liberty to do so in accordance with law i.e., either in granting permission for construction of temple or otherwise. 5) With the above direction, the writ petition is disposed of. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
