HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.10674 of 2018 ORDER:

The petitioners are accused Nos.1 & 2 of crime No.60 of 2018 of Bhakarapet Police Station, Chittoor District, registered for the offences punishable under Sections 323, 341, 506 r/w 34 IPC and Sections 3(1)(r) & (s) of SC & ST (POA) amended Act 2015 (for short 'the Act'). Heard learned counsel for the petitioners and learned Public Prosecutor representing the State in opposing the bail application and perused the FIR, bail application averments and the material on record.

A perusal of the FIR shows there is prima facie accusation within the meaning of Section 3(1)(r) & (s) of the Act, but for that there is no other allegation much less to say any other injuries sustained to register under Section 323 IPC or the so called offences under Section 341 and 506 IPC.

Having regard to the above, because of the bar from the accusation to grant anticipatory bail including under Section 482 Cr.P.C., this Criminal Petition is rather than dismissal, disposed of by giving liberty to the petitioners to surrender before the learned Special Judge by moving regular bail application with notice to learned Public

Dr.SSRB,J Prosecutor to consider granting of bail with necessary conditions.
