THE HONOURABLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No. 12424 of 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.1,2 & 5 seeking to quash the proceedings in Crime No.153 of 2011 of Ghanpur P.S., Warangal District, for the offences under Sections 406, 409, 420, 468, 471 read with Section 34 I.P.C. Heard the learned counsel for the petitioners/accused Nos.1, 2 & 5 and the learned Public Prosecutor and perused the material available on record.
The complaint was filed on 31.07.2016. Thereafter, the disputes between the parties were settled and a Memorandum of Understanding came to be executed on 09.08.2011 and it was agreed that the present crime should be withdrawn. In pursuance of the Memorandum of Understanding, necessary applications were also filed before the Superintendent of Police, D.S.P., C.I., and S.H.O. concerned, informing about the compromise and withdrawal of the complaint. However, it seems that the police filed a charge sheet on 02.08.2016.
In view of the above facts and since the matter has already been settled between the parties long back, the Criminal Petition is disposed of, directing the petitioners/accused to file an appropriate
application before the Court, where the charge sheet has been filed, for recording the compromise. On filing of such application, the Court shall consider and dispose of the same, in accordance with law. Miscellaneous petitions pending in this petition, if any, shall stand closed.
