HON'BLE SRI JUSTICE S.V.BHATT W.P. No.24289 OF 2011 ORDER:

The petitioner prays for the following relief: "...writ of mandamus declaring the action of the respondents in not disbursing the amount of Rs.1.00.000/- along with interest of 24% per annum which is due and payable to the petitioner for completing the work under Flood Damage Repair scheme vide Proceg.No.To/FDR/07, dated 16.01.2008 road from PS Road to Penchalakona Road (Via) Chintalapalem and the Estimated Cost Rs.1,00,000/- arbitrary and contrary to law and also in violation of Articles 14 and 21 of the Constitution of India, consequently direct the respondents to consider his representation dated 11.08.2011..." On instructions, on 15.03.2012, then Assistant Government Pleader for Panchayat Raj represented that necessary Government Orders have been passed and respondents will be instructed to ensure payment by the next date of hearing.

The Assistant Government Pleader (Panchayat Raj) basing on the written instructions dated 20.03.2013 submits that the respondents paid Rs.75,847/ - (Rupees Seventy Five Thousand Eight Hundred and Forty Seven only) to petitioner and the petitioner on 05.03.2012 acknowledged the same.
