HON'BLE SRI JUSTICE M.S.K. JAISWAL Writ Petition No.16436 of 2016 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the fifth respondent in issuing the Impugned Notice dated 23.04.2016 pursuant to G.O.Ms.No.191, Revenue (Assignment) Department, dated 07.10.2015 and Government Memo No.8616/ASSN-II(2)/2016-4 dated 23.04.2016, as arbitrary, illegal and contrary to the provisions envisaged under the Evacuee Property Act, 1950 and Rules made thereunder.

Learned Government Pleader for Revenue (Telangana), on instructions, submits that the item Nos.16 to 38 were initially included in the Auction and however, subsequently, the same were deleted from the list of properties to be auctioned, and for the remaining properties, e-auction was already held. It is not denied that the properties, which are covered in the present writ petition, fall within the excluded properties from the list of e-auction. In view of the above, the writ petition is disposed of placing on record the submission of the learned Government Pleader for Revenue (Telangana).

Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
