THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.11106 of 2016 ORDER:

Petitioners' grievance is that 2nd respondent had entertained an appeal filed by respondent Nos.4 and 5 even though this Court has held that such an appeal against issuance of pattadar pass book does not lie under Section 6-A of the A.P. Rights in Land and Pattadar Pass Books Act, 1971 in a decision reported in Ratnamma Vs. The Revenue Divisional Officer, Dharmavaram, Ananthapur District and others[1].

2. It is not in dispute that no order has been passed by 2nd respondent in the appeal as on date. If any adverse order is passed to petitioners, then the petitioners would be at liberty to question the same. Therefore at the present moment, the Writ Petition is premature since 2nd respondent has not passed any order in the appeal.

3. Granting liberty to petitioners to approach this Court in case there is adverse order against them in the appeal pending before the 2nd respondent, the Writ Petition is dismissed. No costs.

4. As a sequel, miscellaneous petitions pending if any, in this Writ Petition shall stand closed.
