THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 38302 of 2015 ORDER:

The prayer of the petitioner in this case is as follows: "For the reasons stated in the accompanying affidavit, it is prayed that the Hon'ble High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 2nd respondent herein in not endorsing Additional Trip Mulbagal to Bangalore (1RTD) in the endorsement of the Counter-signature temporary permit vide R.No.347/B1/2015 dated 08.09.2015 contrary to the temporary permit No.1059/2015-16 issued by the 3rd respondent herein and contrary to the provisions of the Motor Vehicles Act and consequently direct the 2nd respondent herein to issue modified endorsement by including Additional Trip Mulbagal to Bangalore (1RTD) (counter-signature) and pass such other order or orders as are deemed fit and proper in the circumstances of the case."

It is however admitted by Sri B. Chandrasekhar, learned counsel for the petitioner, that the permit dated 08.09.2015 was subsequently cancelled by the State Transport Appellate Tribunal, Karnataka, on 14.12.2015 in R.P.No.420/2015.

That being so, the issue raised in this Writ Petition is rendered purely academic and does not warrant adjudication. Though Sri B. Chandrasekhar, learned counsel would contend that the impugned action of the respondent authority is still required to be explained, it is not for this Court to adjudicate purely academic issues on the premise that such adjudication may be useful in future. It shall be open to the petitioner to raise the issue if the cause arises once again. Reserving liberty to the petitioner to do so, the writ petition is dismissed.

Pending miscellaneous petitions shall also stand dismissed. No order as to costs.
