HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.26828 of 2016 ORDER:

When the matter is taken up for hearing, learned counsel on either side fairly concede that the issue involved in this writ petition is squarely covered by the order dated 14.03.2016 passed by this Court in Writ Petition No.7100 of 2016. In view of the said submission, following the order dated 14.03.2016 in Writ Petition No.7100 of 2016, the writ petition is allowed and impugned order is set aside. The respondents are given liberty to issue notice to the petitioner calling for objections for change of Category of Service Connection. On consideration of the objections along with the material, if any, that may be filed by the petitioner, the competent authority shall pass speaking order and communicate the same to the petitioner. Till such a decision is taken, the petitioner is directed to pay the electricity charges under LT Category-III(A). The bills of the petitioner shall, however, be subject to the revision depending upon the result of the enquiry and the order that may be passed by the competent authority as directed above. No order as to costs.
