HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 28873 of 2011 Order:
The petitioner claims to be a real estate dealer, doing business in and around Visakhapatnam. He states that he was involved in three criminal cases which are not serious offences. In spite of the same, a rowdy sheet was opened against him contrary to the Standing Order No.601 of AP Police Manual. He sought a declaration that opening of rowdy sheet against him in the police station of the third respondent was illegal.
2. Learned Government Pleader for Home, on the basis of instructions, submits that the petitioner is facing trial in three criminal cases and opening and maintaining of rowdy sheet against the petitioner is justifiable. He further submits that the activity of the petitioner is still active and close monitoring is required.
3. In view of the involvement of the petitioner in three criminal cases, this Court is not inclined to grant the relief sought for by the petitioner in the present Writ Petition. However, it is always open to the authorities, suo motu or on the application of the petitioner, to review the continuance of the rowdy sheet against the petitioner and this order will not prevent such review.
4. With the above observation, the Writ Petition is dismissed. However, in the circumstances, no costs.
5. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
