HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 6 4 0 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Dharmaram Police Station, Ramagundam Commissionerate, dated 16.11.2018, are placed on record by the learned Government Pleader. To the extent of their relevance, the said instructions read as under: - "In view of the above mentioned facts, it is submitted that the allegations made in the affidavit are not correct and are hereby denied. The allegation that the Police are threatening the petitioner to settle the civil disputes with the respondents 10 and 11 by withdrawing pending civil cases is false, baseless and denied. The said allegation has been made only for the purpose of the Writ Petition. With regard to taking action on the petitioner's compensation 08.08.
2018, it is submitted that, as stated above, as per the directions of the Commissioner of Police, Ramagundam, the C.I. of Police, Peddapalli enquired into the matter and submitted a report, dated 08.09.2018, to the Commissioner of Police. It is submitted that based on the complaint given by the 10th respondent, the Police have registered Cr.No.86/ 2017 under Section 427, 506 I.P.C. against the petitioner's husband and son and after completion of investigation filed charge sheet before the concerned Court vide C.C.No.391/ 2017 and it is pending trial and stands posted to 22.01.2019 for summons. The petitioner herein without mentioning the said facts in the Writ Petition falsely contending that the Police are interfering with their possession and harassing her. The said allegations have been invented for the purpose of the Writ Petition.
There is no iota of truth in the said allegations. It is submitted that there are no merits in the above Writ Petition and it is liable to be dismissed."
Having regard to the above said contents, keeping in view of the submission of the learned Counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, by placing on record the said instructions furnished by the Station House Officer, Dharmaram Police Station, Ramagundam Commissionerate, dated
16.11.2018, with a further direction to the respondent-Police authorities not to interfere with the civil disputes unless the same is permissible in accordance with law.
