This criminal petition is filed by the petitioners/accused/appellants seeking enlargement on bail in C.C.No.2325 of 2019 pending on the file of the learned XVIII Additional Chief Judicial Magistrate, Secunderabad. 2.

The brief facts of the case are that the petitioners herein were sent to the jail by executing the NBW issued by the trial Court, as the petitioners were not able to pay the

20% of the compensation, as directed by the trial Court by allowing the petition vide order dated 25.03.2025 in Crl.M.P.No.1035 of 2025 in Crl.A.No.116 of 2025 in C.C.No.2325 of 2019, pending on the file of the learned XVIII Additional Chief Judicial Magistrate, Secunderabad. 3.

Heard Sri Kasani Sridhar, learned counsel for the petitioners, Sri L. N. Bhadriraju, learned counsel appearing for the respondent No.1 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent No.2-State.

Learned counsel for the petitioners submitted that the petitioners are unable to pay the 20% of the compensation as directed by the trial Court and they are willing to pay 10% of the compensation directed by the appellate Court and prayed the Court to allow this criminal petition. 5.

On the other hand, learned counsel appearing for the respondent No.1 opposed the same stating that the petitioners herein filed application for extension of time before the Appellate Court, wherein the Appellate Court

granted time and also directed to pay the amount in three instalments. It is further submitted that inspite of extending the time and also granting instalments, the petitioners herein have not obeyed the order of the trial Court, therefore, they are not entitled for any relief in the present case and prayed to dismiss this petition. 6.

Having regard to the submissions made by both the learned counsel and the material on record, it appears that the petitioners are in jail since 05.12.2025. It is the specific contentions of the learned counsel for the petitioners that the petitioners are unable to secure 20% of the amount of compensation as ordered by the Appellate Court, as such, they were unable to pay the amount. Considering the same, this Court deems it fit to direct the petitioners to pay 10% of the compensation amount before the Concerned Court. Further, the petitioners are directed to co-operate with the Appellate Court.

In view thereof, this Criminal Petition is allowed granting bail to the petitioners subject to the condition that the petitioners shall pay 10% of the compensation amount

before the Concerned Court, within a period of two (02) weeks from the date of receipt of a copy of this Order. Miscellaneous applications, if any pending, shall stand closed.
