HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12977 OF 2011 ORDER:

This petition is filed for a writ of certiorari calling for records relating to the permit bearing No.354/HO/WZ/Cir-14/2010, dated 23.12.2010 in File No.41490/26/10/2010, issued by the respondents 2 and 3 in the name of 5th respondent in respect of the property admeasuring 853.34 sq.ys. bearing Plot Nos.196, 197, 202 and 203 in Sy.No.18, Babbuguda Village, Balanagar Mandal, R.R.District and quash the same as being illegal and arbitrary. This Court on 30.04.2011 while admitting the writ petition passed interim order directing the respondents 2 and 3 to look into the grievance of the petitioners and take appropriate action in accordance with law after due notice to the respondents 4 and 5 within three weeks. Now it is stated that in pursuance to the interim order dated 30.04.

2011, passed by this Court the respondent Corporation has issued show cause notice dated 04.06.2011 to the 5th respondent under Section 450 of HMC Act, 1955 and after receiving reply from the 5th respondent on 19.06.2011, the respondent Corporation stopped the ongoing works. It is also stated that at present there is no work in progress and that building permission granted in favour of 5th respondent is kept in abeyance vide proceedings dated 25.07.2015. In view of the above, the grievance of the petitioners stood redressed. Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in the writ petitions shall stand closed.
