There is no proof of service filed. Leave apart, the rejection of plaint is decree from the impugned order covered under Order VII Rule 11 Clauses (a) and (d) CPC within the meaning of Section 2(2) CPC, for remedy of appeal lies, from not excluding maintainability of appeal against the decree under Section 96 CPC.

Accordingly and in the result, the Civil Revision Petition is dismissed.
