THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9175 of 2016 ORDER:

This Criminal Petition is filed by the petitioners/A-1 & A-2 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.263 of 2016, on the file of Kachiguda Police Station, Hyderabad, registered for the offence punishable under Section 3(1)(r) of SCs & STs (POA) Act. Heard and perused the material available on record. The allegations against the petitioners/A-1 & A-2 are that on 20.06.2016 at about 16.30 hours, when the de facto complainant along with one Laxman were sitting on the Honda Activa Scooter of A-1, A-1 came in a drunken condition and abused the de facto complainant in the name of his caste.

The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.
