HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.5845 of 2018 ORDER:
Aggrieved by an order passed in an application under Order VIII Rule 3 of the Code of Civil Procedure, 1908, the plaintiff in a suit for declaration of title, has come up with the above revision.
2. Heard Mr. C. Prakash, learned counsel for the petitioner and Mr. Ch. Ramesh Babu, learned counsel for the respondents.
3. The application allowed by the trial court is only for filing certain documents on the side of the defendants, subject to proof and relevance at the time of trial. It is true that the Code of Civil Procedure expects the defendant to file all the documents along with the written statement. But, the respondents have assigned reasons as to why they could not do that. Hence, I find nothing wrong in the order of the trial Court warranting interference. Hence, the Civil Revision Petition is dismissed. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
