THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 34165 of 2014 ORDER:

The grievance of the petitioner is that, as against the order dated 04.11.2013 passed by the 3rd respondent under the A.P. Scheduled Area Land Transfer Regulation Act, 1959, as amended in 1 of 1970 Regulation, an appeal has been preferred before the 2nd respondent and, along with the appeal, a stay application has also been filed. Without disposing the stay application, the petitioner is sought to be dispossessed at the instance of the 5th respondent.

2. This Court, on 13.11.2014, granted interim orders of status quo existing with regard to the possession of the land, and adjourned the matter by two weeks at the request of the Government Pleader to get instructions. On 27.11.2014, a further time of six weeks was granted to the learned Government Pleader, and the interim order dated 13.11.2014 was continued.

3. Today, when the matter is called, learned Government Pleader requests further time.

4. Inasmuch as the merits of the case has to be gone into by the 2nd respondent, and having regard to the fact that the limited grievance of the petitioner is to the extent of his stay application not being taken up for disposal by the 2nd respondent, I deem it appropriate to direct the 2nd respondent to pass appropriate orders on the stay application, in accordance with law, as expeditiously as possible, preferably not later than four weeks from the date of receipt of a copy of this order. Till such time the orders are passed by the 2nd respondent on the stay application, the status quo order granted by this Court on 13.11.2014 shall continue.

5. The writ petition is, accordingly, disposed of. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
