ORDER
The petitioner, who is A.1 in crime No.138 of 2016 of Arundalpet Police Station, Guntur Urban, filed the present application under Section 438 Cr.P.C. seeking release in the event of her arrest in connection with above crime registered for an offence punishable under Sections 452, 427 and 506 r/w.34 of Indian Penal Code.
The case of the prosecution is as under:
On 24.05.2016, the 1st informant lodged a report stating that on 24.05.2016 the petitioner and her son trespassed into the house of the daughter of the 1st informant, abused her in filthy language, damaged the window glasses and threatened the 1st informant with dire consequences. Heard learned counsel for the petitioner as well as the learned Public Prosecutor for the State.
A reading of the First Information Report clearly discloses that the petitioner herein is alleged to have entered into the house of the daughter of the 1st informant and caused damage to the property by breaking the window glasses apart from abusing the informant. Having regard to the nature of allegations made against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. However, as the petitioner is a lady and as all the offences are triable by Magistrate, the petitioner, if so advised, shall appear before concerned Court within two weeks from today and move an application for grant of bail after giving prior notice to the Public Prosecutor, in which event the Court below shall consider her release on the same day on such terms and conditions as it deems fit on the same day. Accordingly, the Criminal Petition is disposed of.
