THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6878 of 2016 ORDER:
This Criminal Petition is filed by the petitioner-accused No.2 seeking to quash the proceedings against her in CC No.245 of 2015 on the file of the Judicial Magistrate of First Class, Mahabubabad. Heard and perused the material available on record. The petitioner is alleged to have committed the offences punishable under Sections 420, 447 and 506 IPC. It is alleged that the petitioner and her father (A1) agreed to sold their land to the de facto complainant to a total sale consideration of Rs.1,66,00,000/- and received an amount of Rs.1,54,00,000/-. After receipt of the part payment, A1 registered his land in the name of the de facto complainant, but the petitioner failed to register her land. Therefore, the de facto complainant filed the present case. The matter pertains to the civil disputes and the same has to be tried by the trial Court. Hence, this Court is not inclined to quash the proceedings against the petitioner.
Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J April 29, 2016.
