HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.No.8992 of 2015 ORDER :

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners/accused to quash the proceedings in Cr.No.17 of 2015 on the file of the Station House Officer, Panjagutta, Hyderabad, registered for the offences punishable under Section 420 of I.P.C. on the report of the respondent Nos.2 to 13complainants.

2. Heard the learned counsel for petitioners so also the learned Public Prosecutor representing State-1st respondent before admission and before notice to the respondents 2 to 13 and perused the material on record.

3. It is contention of the learned counsel for the petitioners that the so called Oversees Placement Services, to which A.1 is shown as Managing Director, is only concerned with providing interaction with the so called employer with the complainants for the prospective employment in the selection process depending upon merit and their role is nothing and so far as the 2nd petitioner is concerned, he is a professor, husband of said Managing Director(A.1) and so he has no role and when it is a private employment on merit and the respondents 2 to 13 stated in their complaint that they were terminated by the company, there is nothing even from the report showing how the petitioners are privy to the so called alleged cheating, hence it is a fit case for quashing.

4. As the material, in fact, falls short for this Court to admit the petition to quash petition to quash the proceedings in Cr.No.17 of 2015 supra as it requires the investigation shall go on but the factual matrix entitles for concession of bail to the petitioners.

5. Accordingly, the Criminal Petition is disposed of by giving liberty to

the petitioners to surrender before the learned Magistrate concerned and move an application for regular bail with a notice to the Public Prosecutor concerned, in such an event, after hearing, the learned Magistrate, to grant bail preferably on the same day with necessary conditions. Consequently, miscellaneous applications, if any, pending in this Petition shall stand closed.
