HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

W.P.No.38844 of 2013 is disposed of by order, dated 02.01.2014, directing the Sub-Registrar, Rural Tirupathi, Chittoor District, to receive and process the document presented by the 4th petitioner in respect of the land to an extent of Ac. 25.00 cents in Survey Nos.13, 15, 17/2, 17/3 and 17/5 of Avilala Village, Tirupati Rural Mandal, Chittoor District, without reference to letter R.C.No.N1/27520/2009, dated 19.04.2010, of the Commissioner of Endowments. Alleging that the said orders are not complied with, this contempt is filed.

2. The stand of the respondents is that since the petitioner has not presented the document, the question of processing the document and the question of disobeying the orders of this Court does not arise.

3. When the matter is taken up, learned counsel for the petitioner submits that the contempt be closed by giving liberty to the petitioner to present the document.

4. Since as seen from the averments, it cannot be said that the respondents committed contempt warranting

initiation of proceedings of contempt, the Contempt Case is closed accordingly. It is needless to observe that it is always open to the petitioner to present the document before the competent authority and as and when the document is presented, the competent authority shall consider the same, in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
