ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.67 of 2025 before the INSP ADMIN (DD)
Police Station, Hyderabad, registered for the offences punishable under Sections 61(2), 316(2), 318(4), 319, 337, 340(2), 341 and 238 read with 3(5) of BNS.

Heard Ch. Jayakrishna, learned counsel for petitioner, as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent. 3.
As seen from the record, the petitioner was implicated for the offences punishable under Sections 61(2), 316(2), 318(4), 319, 337, 340(2), 341 and 238 read with Section 3(5) of the BNS, wherein all the offences are punishable with imprisonment of less than seven (07) years. Earlier, the petitioner filed a quash petition, which was dismissed on the grounds that the crimes are pending against the petitioner, and the application for anticipatory bail was also dismissed by the trial Court on the same ground. However, the contention of the petitioner is that the crimes pending against the petitioner are subsequent to the registration of the present crimes and that the allegations therein are similar in nature. 4.
Therefore, since the punishment prescribed for the offences alleged against the petitioner is less than seven (07) years, this Court deems it appropriate to direct the petitioner
to appear before the Investigating Officer on or before 31.12.2025 between 11:00 a.m. and 05:00 p.m. In turn, the Investigating Officer is directed to follow the procedure laid down under Section 35(3) of the BNSS (previously Section 41A of the Cr.P.C.) and to scrupulously adhere to the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1. However, the petitioner shall submit his defence and cooperate with the Investigating Officer as and when required by furnishing information and producing all relevant documents/material required for the purpose of investigation, and the Investigating Officer shall consider the same before filing an appropriate report before the learned Magistrate concerned.

Accordingly, the Criminal Petition is disposed of. Miscellaneous applications, if any pending, shall also stand closed.
