THE HON'BLE SRI JUSTICE A.V. SESHA SAI Writ Petition No. 29584 of 2011 Order:
In this writ petition the petitioner is questioning the action of the respondents - railway authorities in not disbursing the death benefits of her father and also the non-consideration of her case for compassionate appointment.
2. When the matter is taken up, a preliminary objection with regard to maintainability is taken by the learned Standing Counsel appearing for the respondents - railways stating that the present writ petition is not maintainable in view of availability of alternative remedy of approaching the Central Administrative Tribunal to the petitioner for redressal of her grievance.
3. In view of the above, the writ petition is dismissed keeping it open for the petitioner to approach the Central Administrative Tribunal for redressal of her grievance, if she is so advised. There shall be no order as to costs.
4. As a sequel thereto, the miscellaneous applications, if any, pending in the writ petition shall stand closed. __________________ A.V. SESHA SAI, J.
