HON'BLE SRI JUSTICE C.PRAVEEN KUMAR W.P. No. 36328 of 2018 ORDER:

The present writ petition came to be filed seeking issuance of a writ of mandamus, declaring the action of the Tahsildar, Medikondur Village and Mandal, Guntur District, in seeking to dispossess the petitioner at the behest of the unofficial respondents, without following due process of law, as illegal, improper and incorrect.

The petitioner, who is a landless and houseless poor widow, has made an application to the Tahsildar for grant of house site. After considering the eligibility criteria, the matter was placed before the Assignment Committee and the petitioner was selected as one of the beneficiaries to the house site. Accordingly, DK No.2/ 12 dated 12.11.2012 was issued in favour of the petitioner, assigning Plot No. 72/ A in Survey No. 147/ 2 of Medikondur village and Mandal. While matters stood thus, it is stated that the Tahsildar is trying to dispossess the petitioner, at the behest of the unofficial respondents.

The Government Pleader for Revenue would submit that as the Tahsildar has issued the DKT patta in favour of the petitioner, the question of he interfering with the property in dispute, does not arise.

Having regard to the above, the writ petition is disposed of at the admission stage, directing the Tahsildar not to interfere with the property in dispute, if the petitioner is in possession, except in accordance with law. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
