HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 6 3 3 4 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Tsundur P.S., Guntur District, dated 05.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is respectfully submitted that the allegations made by the petitioner that on 02.10.2018 the respondent No.3 along with his staff went to his house, harassed her and tried to arrest him is false and denied herewith. As the respondent police never went to the house of the petitioner and never tried to arrest him. Further, it is to submit that NBWs were pending against one Bontha Papi Reddy in Cr.No.64/ 1991, but not against the petitioner. Further, it is to submit that the respondent Police never tried to arrest the petitioner or tried to execute any warrant against the petitioner and the allegations made by the petitioner that he was harassed or that warrants were being tried to execute on him is false and denied herewith.

It is respectfully submitted that NBW was issued against one Bontha Papi Reddy, S/ o.Koti Reddy in Cr.No.64/ 1991 of Tsundur P.S., in the year 2017. In this connection, the respondent Police tried to execute NBW against Bontha Papi Reddy, but he was not residing in Munnagivaripalem village. On that, the respondent Police recorded the statements of villagers and also addressed a letter to the Tahsildar, Tsundur Mandal to furnish information about availability of Bontha Papi Reddy, in Munnangivari Palem village, Tsundur mandal. The Tahsildar, Tsundur Mandal has addressed a letter to

the Sub-Inspector of Police, Tsundur P.S., vide Lr.RC.No.420/ 2018-A, dt. 24.10.2018, stating that on verification of voters list, it is found that no person is available with the name of Bontha Papi Reddy in Munnangivari Palem village, Tsundur Mandal. On that the Sub-Inspector of Police, Tsundur P.S., has filed a Memo before the Judicial Magistrate of First Class, Special Mobile Court, Guntur, on 02.11.2018, with a request to return NBW against Bontha Papi Reddy, as he is not in Munnagivaripalem village."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Tsundur P.S., Guntur District, dated 05.11.2018.
