HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3075 of 2015 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Home.

Petitioners 1 and 2 are husband and wife and they alleged in the affidavit that the 3rd respondent is harassing them by calling over cell phone and thereby interfering with their life and liberty and threatening them to arrest, though no complaint is filed against the petitioners.

Learned Government Pleader for Home has received instructions, which state that the mother of the 1st petitioner lodged a complaint before the 3rd respondent on 25-01-2015 requesting to take action against the 1st petitioner and his wife i.e., 2nd petitioner on the ground that they are demanding gold and cash from her and are pressurizing and causing serious mental harassment. On receipt of the said complaint, general dairy entry was made on 25-01-2015 and to know the veracity of the said complaint, the 3rd respondent tried for the 1st petitioner, but he did not respond. It is also stated that the dispute between the petitioners and the old lady, who is aged 70 years, is civil in nature and the respondent police are nothing to do with it.

As the mother of the 1st petitioner lodged complaint, police have only counselled the petitioners and warned them not to interfere with her peaceful life at this old age. It is also stated that with regard to civil disputes, police have no role to play and except counselling the petitioners, no other action was taken and no case is registered against the petitioners, basing on the complaint of the mother of the 1st petitioner.

In view of the above instructions, it is apparent that no case is registered against the petitioners except counselling made by the police and that the police have not taken any coercive action against them. The allegations made in the writ petition are not substantiated. Hence, the writ petition is dismissed. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
