ORDER:
This Writ Petition is filed with the grievance that contrary to the Rules framed under G.O.Ms.No.334, Panchayat Raj and Rural Development (Pts.IV) Department, dated 09.10.2012, respondent Nos.4 and 5 are proposing to erect a cell tower over a private building situated adjacent to the school.
At the hearing, Mr. P.Ramakrishna, learned counsel representing Mr. G.Narender Reddy, learned Standing Counsel for respondent No.2 and Mr. P.Hema Chandra, learned counsel representing respondent No.3, submitted that permission for erection of the cell tower was granted by respondent No.2 on 01.11.2015. Unless the petitioners question the permission granted by respondent No.2 for erection of the cell tower, they cannot succeed in this Writ Petition.
Therefore, the Writ Petition is dismissed, however, with liberty to the petitioners to avail appropriate remedy for questioning the permission granted by respondent No.2 for erection of the cell tower.
