Smt.Waadapally Kanthamma And 2 Other v. The State Of Ap., And Another
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.6544 OF 2013 ORDER:
This Criminal Petition, under section 482 of Cr.P.C., is filed by the Petitioners/Accused Nos.1 to 3 seeking to quash the proceedings in C.C. No.664 of 2010, pending on the file of the Court of VII Metropolitan Magistrate, Cyberabad at Hayathnagar, Ranga Reddy District (for short, 'the trial Court'), registered for the offences punishable under Sections 498-A and 406 of I.P.C. and Sections 4 and 6 of the Dowry Prohibition Act, 1961. 2.
Heard learned counsel for the petitioners and learned Public Prosecutor, appearing for the 1st respondent - State. None appears for the 2nd respondent - de-facto complainant, in spite of service of notice. 3.
A perusal of the complaint shows that the 1st petitioner is the mother-inlaw and 2nd and 3rd petitioners are the sisters-in-law of the complainant. 4.
Learned counsel for the petitioners submits that the complainant filed D.V.C. No.153 of 2012 and an order was passed by the learned IV Metropolitan Magistrate, Hyderabad, on 10.12.2012, acquitting the 1st petitioner but the reliefs sought for in the D.V.C. and this case are altogether different. 5.
A perusal of the complaint, in this case, shows that specific allegations are made against all the petitioners with reference to dates. 6.
Hence, this Court opines that it is a matter for investigation and not a fit case for quash of the proceedings.
7.
Accordingly, the Criminal Petition is dismissed. 8.
As a sequel, the miscellaneous petitions, if any pending, shall stand dismissed.
