THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10908 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor. Perused the material on record.

2. The present Criminal Petition came to be filed by the petitioner/A.1 under Section 482 Cr.P.C., seeking relaxation of conditions imposed in the order dated 31.03.2016 passed in Crl.M.P.No.506 of 2016 in Crime No.391 of 2015 of Keesara Police Station by the X Metropolitan Magistrate, Cyberabad at Malkajgiri.

3. The Court below while granting bail to the petitioner imposed the following conditions:

"1. The petitioner is directed to execute personal bond of Rs.10,000/- with two sureties for like sum amount;

2. The petitioner is directed to attend the SHO on every alternate day before 10.30 a.m., to 5.00 p.m., till filing of the charge sheet;

3. The petitioner shall not go from the State of Telangana without prior permission of the Court;

4. The petitioner shall deposit the passport if any otherwise file an affidavit in that regard.

5. The petitioner shall not tamper the evidence."

4. Learned counsel for the petitioner submits that though the order was passed on 31.03.2016, till date no charge sheet has been filed and that the petitioner is put to lot of inconvenience by reason of the said conditions.

5. Learned Additional Public Prosecutor submits that

investigation is still pending and presence of the petitioner is very much required before the police.

6. Having regard to the nature of allegations made and also taking into consideration the involvement of the petitioner, the condition of petitioner reporting before the SHO on every alternate day before 10.30 a.m., to 5.00 p.m., till filing of charge sheet is modified as under:

The petitioner shall report before the Station House Officer concerned, once in a week i.e., on every Monday between10:30 A.M., and 5:00 P.M., until further orders. All other conditions imposed by the Court below shall remain un-altered.
