THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36322 of 2018 ORDER:

The alleged inaction on the part of the 1st respondent in disposing of the revision application, dated 11.07.2017, said to have been preferred by the petitioner herein is under challenge in the present Writ Petition.

The petitioner herein made an application for grant of quarry lease for colour granite over an extent of 6 Hectares in Sy.No.69 of Jayagiri, H/o.Laknavaram village, Hasanparthi Mandal, Warangal District and the same was received by the Assistant Director of Mines and Geology, Warangal on 05.03.2015. By way of proceedings D.Dis. No.15721/R1-1/2016, dated 21.06.2017, the Director of Mines and Geology, Hyderabad, Telangana State, rejected the said quarry lease application of the petitioner herein under Rule 12(5)(d) of the A.P.Minor Mineral Concession Rules, 1966. Aggrieved by the said Order of rejection, passed by the Director of Mines and Geology, the petitioner herein preferred a statutory revision under the provisions of Rule 35-A of the Minor Mineral Concession Rules, 1966, on 11.07.2017.

The complaint of the petitioner in the present Writ Petition, in the above background, is that despite lapse of considerable length of time, the 1st respondent-revisional authority has not disposed of the said revision and in view of the same, the petitioner herein is sustaining irreparable loss and hardship.

Heard learned Counsel for the petitioner and the learned Government Pleader.

Keeping in view the nature of controversy, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the revisional authority-1st respondent herein to dispose of the revision, dated 11.07.2017, filed by the petitioner herein against the Orders of the rejection passed by the Director of Mines and Geology-respondent No.2 vide proceedings D.Dis. No.15721/R11/2016, dated 21.06.2017, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this Order, after giving notice to the petitioner herein.
