When the matter was listed on 09.10.2017, learned counsel for the petitioner was not present and there was no representation on his behalf, therefore, the matter was directed to be listed under the caption 'for dismissal' to this day. Even today, learned counsel for the petitioner is not present. It shows that the petitioner is not interested in prosecuting the case.

Hence, the Criminal Petition is dismissed for non-prosecution. Interim stay granted by this Court on 05.09.2011 in Crl.P.M.P.No.8385 of 2011 is hereby vacated. Miscellaneous petitions, if any, pending in this petition shall stand closed.
