Heard learned counsel for petitioner.

At the admission stage, the following Order is passed: As can be seen from the record that the FIR is registered against the accused for the offences under Sections 379 and 120(B) IPC, Section 29(1) (iii) and (x), Section 29(1) (iii) AP Forest Act, 1967 and Rule (3) of A.P. Red Sandal Wood Product Transit Rules, 1970, Section 2 (XV) of Wild Life ( Protection) Act, 1972 and Rule (3) of AP Forest Product Transit Rules and other allied acts. The petitioner is A.2. Sofar as the allegation against him as per the confessional statement of A.1 and A.3 is to the effect that at the instance of A.2, the driver allegedly transported sandal wood and in the meanwhile, they were caught hold by the Police.

As per the Statement of the learned Additional Public Prosecutor, the investigation is reported to be pending and a rowdy sheet is also opened against A.2. Having regard to the prima facie accusation contained in the record and the investigation is in mid way, it is not a fit case to quash the proceedings at this stage. Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any, pending shall stand closed. ______________________ U.
