HON'BLE SRI JUSTICE SURESH KUMAR KAIT Criminal Petition No.15955 of 2016 ORDER:

Vide present petition, the petitioner/ A.5 seeks a direction, thereby directing the Station House Officer, KUC PS, Warangal District, in the event of his arrest in connection with Cr.No.175 of 2016, registered for the offences under Section 8(c) read with 20(B) of NDPS Act, he may be enlarged on bail. On 16.11.2016, learned counsel for the petitioner submitted that the petitioner is innocent; he was falsely implicated in the present case. He does not know any of the accused and had never ever had talk with them in person or over phone.

Thereafter, learned Additional Public Prosecutor was directed to file a report, after verification whether the petitioner had a talk with A.6 or any other accused on 10.09.2016 and 11.09.2016.

Today, call details of the petitioner and A.1 is produced, whereby it is established that the petitioner is very much in contact with A.1 from 05.09.2016 to 16.09.2016 and had number of calls. Normally much in routine manner, a person does not make such much calls. The petitioner has very much connection with A.1 and others and hence, the custody of the petitioner is very much required in this case. Hence, I find no merits in the petition.
