SMT JUSTICE T.RAJANI CIVIL REVISION PETITION No.6058 OF 2018 ORDER:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by the Petitioner - Plaintiff, seeking for short relief of disposal of the Petition i.e., I.A. No.46 of 2018 in O.S. No.89 of 2016, pending on the file of the Court of I Additional District Judge at Srikakulam (for short, 'the trial Court'), which was filed to set-aside the dismiss for default order, dated 26.02.2018, passed in O.S. No.89 of 2016 and to restore the Suit to its original file. 2.

Learned counsel for the petitioner submits that the aforesaid Petition was filed by the petitioner on 06.03.2018. But, the Petition is not being disposed of since then, in spite of respondents' appearance and the counter being filed by them.

Hence, considering the above, this Court opines that the direction need be given to the trial Court.

Accordingly, the learned I Additional District Judge at Srikakulam is directed to dispose of the Petition i.e., I.A. No.46 of 2018, as expeditiously as possible, preferably within one month from the date of receipt of a copy of this Order.

With the above observation, the Civil Revision Petition is allowed. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
