THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO COMPANY APPLICATION NO.618 OF 2011 IN COMPANY APPLICATION NO.682 OF 2002 IN/AND COMPANY PETITION NO.112 OF 2007 ORDER:
The parties to the C.P.No.112 of 2007 have, as per the advice and efforts of the elders, settled the disputes amongst themselves amicably and to their satisfaction. Today, applicants 2 to 5 were present in the Court. In fact on behalf of the 5th applicant, his wife Smt.P.Anitha, W/o P.Ramesh, who works as Home guard was present as Sri P.Ramesh, died prematurely. So far as Smt. Nalla @ Pothuganti Sayamma is concerned, she was present in the Court Premises, but because of her physical disability and ailment she could not take steps and present physically in the
Court. In that view of the matter, Sri K.Prabhakar, Court Officer and K.Sai Pavan Kumar, Court Master have been deputed by the Court to the ground floor to ascertain her views with regard to the compromise entered by the parties. She confirmed the terms of the compromise and her willingness to the officers of the Court. The learned Advocate-Commissioner appointed to discharge the functions of the company under liquidation M/Southern Continental Contractors Limited (In Liquidation) has also drawn two cheques bearing Nos.696278 and 696279 in a sum of Rs.50,000/- each payable to Sri P.Balaraj and Sri P.Shriramulu as per the terms of the compromise and with the permission of the Court have also passed on the same to the respective parties in the Court itself. In this view of the matter the Company Petition No.112 of 2007 stands disposed of as per the terms and conditions settled in the compromise, spelt out in the Company Application No.618 of 2011. No costs.
The Court places on record the appreciation of the efforts put in by all concerned for settling the dispute amongst themselves.
