This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who is arrayed as accused Nos.1, 2 and 5 in Crime No.294 of 2025 before the Thallada Police Station, Khammam District, registered for the offences punishable under Sections 296(b), 351(2) and 108 of Bharatiya Nyaya Sanhita (BNS).

The brief facts of the case are that, on 09.10.2025, the de-facto complainant, who is the mother of the deceased, lodged a report before the police stating that her younger son, an electrician, was in love with a girl. About twenty days prior to the incident, a panchayat was convened before the village elders, where both families were admonished. On 02.10.2025, the accused allegedly came to the complainant's house, abused her son in filthy language, and threatened to kill him. Out of fear and humiliation, on 08.10.2025, her son consumed poison and, despite treatment, died on 13.10.2025. Initially, a case was registered against the accused under Sections 296(b) and 351(2) of BNS. Subsequently, after the death of the deceased, Section 108 of BNS was added. 3.
Heard Sri B. Muralidhar, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners were in no way responsible for the death of the deceased and, even according to the complaint, the incident
had taken place on 02.10.2025, while the deceased consumed poison on 08.10.2025. He further contended that there was no suicide note or dying declaration indicating that the petitioners had abetted or were the reason for the death of the deceased. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing the criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, stating that the allegations against the petitioners were grievous in nature and that the investigation had not yet been completed. Therefore, granting pre‐arrest bail to the petitioners, at this stage, does not arise and prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it was noted that accused Nos.1 and 2 are the parents of the girl and accused No.5 is a relative of the girl. Even according to the complaint, the alleged abuse occurred on 02.10.2025, while the deceased consumed poison on 08.10.2025, and there is no suicide note or dying declaration to indicate
abetment. Considering the overall facts and circumstances of the case, this Court deems it fit to grant pre‐arrest bail to petitioners‐accused Nos.1, 2, and 5, subject to the following conditions:
i.
The petitioners-accused Nos.1, 2 and 5 shall surrender before the Station House Officer, Thallada Police Station, Khamma District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioners-accused Nos.1, 2 and 5 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners-accused Nos.1, 2 and 5 shall appear before the concerned Investigating Officer on every Monday and Friday between 09:00 a.m, and 05:00 p.m., till the filing of the charge
sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
