HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.3277 of 2011 ORDER:

This writ petition is filed to declare the action of the respondents 1 and 2 in disconnecting water tap connection sanctioned in the name of the petitioner as illegal.

The case of the petitioner is that the property bearing Door No.10-19-76, satiated at Brahmin street, Vijayawada belongs to the joint family consisting of the petitioner and his brothers. The said number has water tap connection and when the respondentauthorities have disconnected water supply, the petitioner filed W.P.No.12784 of 2004 and this Court has granted interim orders and when the same was restored in the month of November, 2004. Later, the same was disconnected on the ground that earlier writ petition was dismissed as infructuous.

While admitting the writ petition, this Court granted interim orders on 14-02-2011.

A counter is filed by the 1st respondent stating that since the petitioner could not file necessary documents and there are civil disputes pending between the petitioner and the 3rd respondent, water supply connection was disconnected.

Since learned counsel for the petitioner states that the disputes pending between the petitioner and the 3rd respondent before the Civil Court ended in compromise and since the interim order was operating since 2011, I deem it appropriate and proper that the petitioner shall approach the 1st

respondent with all necessary documents and file representation regarding his entitlement of supply of water to the said house within a period of six weeks from today and on such application, the respondent-authorities shall consider the same and take action accordingly. Till then, the interim granted by this Court on 14-02-2011 shall continue. If the petitioner does not approach the respondentauthorities in the aforesaid time, it is for the 1st respondent to take appropriate action in accordance with law. With the above direction, the Writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
