2. Petitioner is aggrieved by the action of the third respondent in refusing to entertain the Sale Deed, dated 08.08.2014, pending Registration as document P.No.41 of 2014, dated 08.08.2014. The said Sale Deed relates to vacant site admeasuring an extent of Ac.83.00 square yards in survey No.653/3, 1st Ward, Ungarala Nagar, Koduru Gram Panchayat, Koduru Village and Mandal, Y.S.R. District. By this writ petition petitioner questions the refusal order passed by the third respondent dated 08.08.2014 stating that in view of the orders passed by this Court in C.R.P.No.1147 of 2012, the document cannot be registered. Petitioner contends that neither the petitioner is a party nor his vendor is a party to the O.P.No.34 of 2004 on the file of the V Additional District Judge, Tirupati or C.R.P.No.1147 of 2012.
3. Learned Assistant Government Pleader for Revenue, on instructions, states that as per the RSR the land in survey No.653/3 to an extent of Ac-0.94 is classified as patta land and the same stands in the name of Kotha Gandla Ramaiah.
4. Both the learned Counsel states that this writ petition is similar to the one considered by this Court in W.P.No.33693 of 2013, dated 26.11.2013. Hence, there shall be a like order in this writ petition also. "The Writ Petition is disposed of directing the Sub-Registrar, Pullampet, to verify as to whether the property covered by the subject document is part and parcel of E-Schedule property in O.P.No.34 of 2004 on the file of the learned V Additional District Judge, Tirupathi, and if so, as to whether it is sought to be sold by respondents 1 to 47 in
the said O.P. or any persons claiming through them. If these two factors are not made out, the Sub Registrar, Pullampet, shall process the subject document and in the event it is found to fulfil the requirements of the Registration Act, 1908, and the Indian Stamp Act, 1899, he shall complete the registration formalities and release the document in accordance with the due procedure."
As a sequel, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
