This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.3, for grant of bail in Crime No.23 of 2018 of Orvakal Police Station, Kurnool District, registered for the offences punishable under Sections 364, 302, 177, 109, 120-B read with 34 of I.P.C.

Heard the learned counsel for the petitioner/ A.3 and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioner/ A.3 would submit that the petitioner/ A.3 has nothing to do with the death of K.Sreenivasulu. The petitioner/ A.3 has no role to play because she is the wife of the accused/ A.1. She is falsely implicated in this case and prayed to allow the petition.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner.

The material on record reveals that A1 to A.3 conspired together, eliminated K.Sreenivasulu, who is the brother of A.1, in order to get an amount Rs.4.00 crores towards insurance. There are specific allegations against the petitioner/ A.3, that she was also part of the plan and conspiracy and intended to do away with the life of K.Sreenivasulu, in order to, get the insurance amount of Rs.4.00 crores. Before his death, K.Sreenivasulu was made to obtain policy of insurance from a private insurance company. The deceased was murdered by using a motor vehicle. The allegations are grave and the punishment for the alleged offences is death or

imprisonment of life. It is not a fit case to allow the petition. The appeal is devoid of merit and is liable to be dismissed. 6.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
