Counsel for the appellants submits that during pendency of the appeal (A.S.No.604 of 2013), the appellants have surrendered possession of the suit premises to the respondent-landlord and, therefore, nothing further survives in the appeal suit. Learned counsel for the respondent-landlord does not dispute the submission and prays for disposal of the appeal suit as infructuous.
