The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 2nd respondent in issuing the Property Tax Special Notice - Revision bearing Spl.No. GHMC/ Cir. 1 104926498 dated 26.02,2018, demanding the petitioners to pay an amount of Rs.1,85,534/ - towards yearly reassessed property tax and an amount of Rs.1,52,848/ - towards unauthorized construction penalty, totaling a sum of Rs.3,38,382/ - (out of the total demand of Rs.3,53,228/ -) over the schedule property from the year commencing from 01.04.2016, as illegal and arbitrary. 2.
At the time when the matter is taken up for hearing, it is brought to the notice of the Court that the petitioners herein made an application on 01.09.2018 raising objections against imposition of unauthorized construction penalty in respect of the schedule property, but, till date, no orders are passed on the said application.

Sri Sampath Prabhakar Reddy, the learned Standing Counsel appearing for the Greater Hyderabad Municipal Corporation would submit that the application dated 01.09.2018 made by the petitioners against imposition of the
unauthorized construction penalty, would be dealt with forthwith.

Having regard to the above, the writ petition is disposed of at the admission stage, directing the 3rd respondent-the Deputy Commissioner, Greater Hyderabad Municipal Corporation, Kapra, Circle No.1, Hyderabad to pass appropriate orders on the application of the petitioners dated 01.09.2018 as early as possible, in accordance with law. Till such time, the 3rd respondent shall not insist on payment of unauthorized construction penalty. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed. _________________________ JUSTICE C.PRAVEEN KUMAR 22.10.2018 DMG
