HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.45120 of 2016 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioners claim that they are the absolute owners and possessors of land in Sy.Nos.417/9, 456 and 457 admeasuring Acs.1.00, 6.09 and 2.34 gts., totally admeasuring Ac.10.30 gts., of Gate Karepalli village of Singareni Mandal, Khammam District. The names of the petitioners were duly recorded in the revenue records and pattadar passbooks; while so, at the instance of the 5th respondent, 3rd respondent has taken up proceedings under the Land Transfer Regulation Act and passed order dated 10.10.2016, ejecting the petitioners from the subject lands. Against the said order, petitioners filed appeal before the 2nd respondent along with an application for stay. When the said application was not disposed of, the present writ petition was filed. Learned Government Pleader, on the basis of instructions, submits that neither the said application nor the appeal was disposed of by the 2nd respondent.

In the circumstances, in view of the order of ejectment dated 10.10.2016 passed by the 3rd respondent, against which an appeal is pending before the 2nd respondent, there shall be stay of further proceedings pursuant to the order dated 10.10.2016 passed by the 3rd respondent, till the disposal of the appeal by the 2nd respondent. Writ petition is accordingly disposed of.

Pending miscellaneous petitions, if any, shall stand closed. No costs.
