THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 36025 OF 2015

O R D E R

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner prays that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS a). Directing 4th respondent not to interfere in any manner with petitioner's personal life and liberty; b). Directing respondents 1 to 5 to remove respondents 6 to 8 and police constables deployed by 4th respondent around the house of petitioner situated at P. Nagulavaram Village in Markapur Mandal of Prakasam District;

c). Directing 4th respondent not to insist the petitioner to pay and settle the false claim of respondents 6 to 8; d). Directing the respondents 1 to 5 to take steps for return of forcibly collected cheques and bond from respondents 6 to 8 and deliver the same to the petitioner and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case." The Deputy Superintendent of Police, Markapur, Prakasam District, filed a counter affidavit denying the allegation made by the petitioner that the police authorities were interfering in civil disputes. He stated that the police authorities were only discharging their legitimate duties and never harassed, threatened or interfered with the civil disputes or life and liberty of the petitioner as alleged.

Though a reply affidavit was filed by the petitioner rebutting the aforestated counter affidavit averments, Sri G. Naresh Kumar, learned counsel representing Sri Nimmagadda Satyanarayana, learned counsel for the petitioner, fairly conceded that it would not be possible for the petitioner to prove before this Court such harassment and interference.

that liberty may be given to the petitioner to work out his remedies before the appropriate forum in accordance with law in relation to the grievance canvassed in this writ petition.

The writ petition is accordingly closed granting liberty to the petitioner to take recourse to appropriate remedies in accordance with law before the appropriate forum if he has any grievance in relation to the cause putforth in this writ petition. Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
