THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 22055 of 2012 ORDER:

The issue arising in this writ petition is squarely covered. A copy of the order dated 15.11.2012 passed by this Court in W.P.No.17998 of 2012 is placed on record.

For reasons alike as were mentioned in the said order, this writ petition is disposed of directing that in case the seigniorage fee on the sand utilized by the petitioners in the works executed by them was deducted from their bills and proof thereof is filed before the Assistant Director of Mines and Geology concerned, no

penalty shall be levied.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
