HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P. No.6011 of 2015 ORDER :

This Criminal Petition is filed by the petitioner/ accused under Section 482 Cr.P.C seeking to quash the proceedings of Crime No.71 of 2015 of Anantapur II Town Police Station, Anantapur District registered for the offences punishable under Section 417, 420, 496 and 323 IPC.

2) Heard learned counsel for the petitioner/ accused and 1st respondent-State represented by learned Public prosecutor before admission and before ordering notice to 2nd respondent-de facto complainant and perused the material.

3) Having regard to the above, the petitioner is entitled to the concession of bail being a police constable in Government service, hence the Criminal Petition is disposed of, giving liberty to petitioner to surrender himself before the learned Judge concerned and move for regular bail with notice to Assistant public prosecutor concerned, in such an event, the learned Judge shall grant bail on the same day with necessary conditions. Needless to say, at post bail stage the presence of the petitioner may be dispensed with. Needless to say further remedy is left open after completion of investigation in the event of police filing final report and after taken cognizance by the learned Magistrate.

4) Miscellaneous petitions, if any pending in this Criminal Petition, shall stand closed.
