HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.41993 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner claims that his father, by name, late Appanna, was an Ex-serviceman and was granted Patta in 1979 under Ex-servicemen quota. After long expiry of ten years, the petitioner seeks to alienate the land admeasuring Acs.3.89 cents in Survey No.283/7 of Amurthapuram Village, Sabbavaram Mandal, Visakhapatnam District, and made an application, dated 01.12.2015, before the District Collector, Visakhapatnam, the 2nd respondent. Alleging that no action is taken on his application, the petitioner filed the present Writ Petition.

Apparently, the petitioner's application is dated 01.12.2015 and hence as of today, there is no inaction on the part of the 2nd respondent and, therefore, mandamus as sought for cannot be issued.

The 2nd respondent has to examine the petitioner's application in terms of G.O.Ms.No.307, dated 06.06.2013, and then take appropriate decision in the matter.

With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
