HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8533 of 2016 O R D E R:

This petition is filed by the petitioner-accused No.3 under Sections 437 and 439 of the Criminal Procedure Code seeking to grant bail to him in Crime No.3 of 2016 on the file of Donkarai Police Station, registered for the offence punishable under Sections 8(c ) r/w 20 (b)(ii)(c )2 of the NDPS Act.

It is alleged that the petitioner was found carrying 783 kgs of ganja.

Learned Counsel for the petitioner submitted that the petitioner did not commit any offence and he was falsely implicated in the above crime and that the petitioner was arrested on 27.3.2016 and since then, he has been in prison.

Learned Additional Public Prosecutor opposed this petition. Considering the facts and circumstances of the case and the quantity of ganja alleged to have been seized from the possession of the petitioner, this Court is not inclined to grant bail to the petitioner at this stage.
