THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO. 14448 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to call for records in PRC No.10 of 2016 on the file of Judicial First Class Magistrate, Huzurnagar, Nalgonda District, registered for the offences punishable under Sections 504, 506 read with 34 IPC and Sections 3(1)(x) of SCs and STs (POA) Act, 1989.

Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings. However, in the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the learned Magistrate to commit the case to the Court of Sessions and the trial Court to dispose of the case as expeditiously as possible, without insisting the presence of the petitioners subject to condition of the petitioners executing bond undertaking to appear before the Court of Sessions as and when required.

Miscellaneous petitions pending if any, shall stand closed. __________________ M.S.K.JAISWAL,J Date: 14.10.2016 kvrm
